These terms are the agreement between you and PXL Security LTD, Sofia, Bulgaria, which publishes Canalith. By downloading or using the app on iPhone or Apple Watch you accept them. If you do not accept them, please do not use Canalith.
We give you a personal, non-exclusive, non-transferable, revocable licence to use Canalith on Apple devices you own or control, for your own diary keeping. Everything else in the app stays ours.
You may not copy, sell, rent, sub-licence or redistribute the app or its exercise content, reverse engineer or decompile it, remove its notices, or work around any technical restriction in it, except where the law allows you to whatever this agreement says.
The diary, watch logging, CSV export and a PDF of your last thirty episodes are free. Canalith Pro is optional and comes two ways: a one-time purchase of $14.99, or $19.99 a year with a seven-day free trial.
Both are sold through Apple's App Store. Apple takes the payment, keeps your payment details and issues the receipt. We never see your card.
The yearly subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period, and your Apple Account is charged within 24 hours of the period ending. A free trial converts to a paid year on the same basis. You can see, manage and cancel a subscription at any time in your Apple ID settings on your device. Cancelling stops the next renewal; it does not shorten a period you have already paid for. The one-time purchase never renews.
Refunds are handled by Apple under Apple's own terms, not by us. We cannot grant or refuse a refund on Apple's behalf, though you are welcome to write to us and we will help where we can.
Canalith is a wellness diary. It is not a medical device. It does not diagnose, treat, cure or prevent BPPV, vestibular migraine, Meniere's disease or any other condition, and nothing it shows you is medical advice.
Patterns the app draws between your episodes and the weather, your sleep or anything else are observations from your own entries, not findings, and correlation is not cause. The guided exercises are general educational descriptions of well-known manoeuvres; they are not a prescription, they are not suitable for everyone, and some causes of dizziness are serious. Ask a clinician before trying them, stop if they make you worse, and seek urgent care for sudden severe dizziness with a headache, weakness, double vision, trouble speaking, or hearing loss.
Use Canalith lawfully and for yourself. Do not use it to give anyone a diagnosis or clinical instruction, do not present its exports as a clinical report, and do not interfere with the app, with Apple Health or with Apple's services. Log safely: sit or lie down first, and never use the app while driving.
Your diary lives on your own device, as set out in the privacy policy. Because we hold no copy, backups are your responsibility, through your own device backup or the app's export. Deleting the app removes its data and we cannot recover it for you.
We may change, add to, or discontinue the app or any feature, and we may stop supporting older versions of iOS or watchOS. Weather capture depends on Apple's WeatherKit and sleep capture on Apple Health, neither of which we control. We will try to give reasonable notice where a change matters, but we do not promise the app will always be available or uninterrupted.
Canalith is provided as is and as available. To the fullest extent the law allows we make no warranties about it, express or implied, including merchantability, fitness for a particular purpose, accuracy, or error-free operation. Weather, pressure and sleep figures can be missing or wrong. Nothing here removes rights you have as a consumer under Bulgarian or EU law that cannot be excluded by agreement.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, for lost diary entries, or for any injury, health outcome or decision made or not made on the basis of the app or its exercises. Where liability cannot be excluded, it is limited to the amount you paid for Canalith in the twelve months before the claim.
We may update these terms as the app changes. The current version always lives at this address with the date at the top, and continuing to use the app after a change means you accept it.
These terms are governed by the laws of Bulgaria, and disputes will be dealt with by the competent Bulgarian courts. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory laws of your own country.
